1. Grant of Access

 

These Terms set out the basis on which Telstra Health provides you with Access to the Leaving Violence Program Online Services. 

Telstra Health grants you Access to and use of the Leaving Violence Program Online Services for the Permitted Purpose in accordance with these Terms. 

Access to Leaving Violence Program Online Services is granted once you have completed the application process and met any other requirements of Telstra Health in relation to the application process. 

You must comply with the Access Documents that relate to the Leaving Violence Program Online Services in addition to these Terms. 

Your Access to the Leaving Violence Program Online Services is by way of non-transferable, non-exclusive, non-sub-licensable, revocable limited licence and is granted solely for the Permitted Purpose. 

You may only Access the Leaving Violence Program Online Services using the login details issued to you by Telstra Health. You must not share your login details with any other person, and must only use login details that have been issued to you as an Authorised User. 

Telstra Health may monitor all actual or attempted Access to, and activity within, the Leaving Violence Program Online Services.

 


 

2. Authorised Users

 

Access to the Leaving Violence Program Online Services may only be made via Authorised Users. Authorised Users must not allow any other person to use their Access to the Leaving Violence Program Online Services. 

If you are an Approved Organisation, you are responsible for ensuring that your Authorised Users comply with these Terms. You agree to notify Telstra Health of any addition, change or removal of your Authorised Users. 

If you are an Authorised User who was nominated for or granted Access by an Approved Organisation, and you cease to be engaged by the Approved Organisation, you must not Access the Leaving Violence Program Online Services, or any information derived from it.

 


 

3. Use of the Services and Privacy

 

You agree, in relation to any Personal Information you access via the Leaving Violence Program Online Services, to: 

  • use Personal Information only for the Permitted Purpose;
  • comply with the Privacy Act (including the Australian Privacy Principles);
  • not do any act or engage in any practice that would constitute a breach of the Privacy Act or any other law;
  • comply with any other applicable law, including applicable state or territory-based health records legislation;
  • take all reasonable steps to protect Personal Information from misuse, loss and unauthorised access or disclosure; and
  • comply with any directions, guidelines, determinations, rules or recommendations of the Information Commissioner to the extent they are consistent with the requirements of this clause.

If you are an Approved Organisation, you must ensure that all of your Authorised Users comply with the obligations set out in this clause 3. 

You must immediately notify Telstra Health if you become aware of, and must comply with any direction from the Telstra Health in relation to any breach or suspected breach by you of any obligations set out in this clause 3, including an approach to you by the Information Commissioner or by a person claiming that their privacy has been interfered with. 

If your Access to the Leaving Violence Program Online Services includes the ability to submit information to the Leaving Violence Program, you acknowledge that you are responsible for the accuracy and appropriateness of any information you submit, and must ensure that any information submitted complies with any applicable policies notified to you by Telstra Health in writing, referred to or made available by Telstra Health in accordance with clause 7. 

Any Personal Information submitted to the Leaving Violence Program will be handled in accordance with the Leaving Violence Program Privacy Statement, which forms part of these Terms. 

In accessing the Leaving Violence Program Online Services, you acknowledge and agree that any Personal Information that you have provided to the Leaving Violence Program will be collected, retained and handled by Telstra Health in accordance with the Privacy Statement. 

You agree to only share with the Leaving Violence Program Personal Information about third parties, in relation to which you have the third party’s permission to provide their Personal Information, and where they have consented to the collection and handling of their Personal Information in accordance with the Privacy Statement. 

 


 

4. Security

 

You must take all reasonable steps to ensure that your Access complies with, and at all times remains compliant with, any guidelines or security protocols set out in your Application or reasonably notified to you by Telstra Health. 

You must ensure that no Harmful Code is transmitted to the Leaving Violence Program Online Services or any other Leaving Violence Program System through or as a result of the Access granted under these Terms. You must not attempt to circumvent or disable security related features of the Leaving Violence Program Online Services. 

“Harmful Code” includes any executable programming or software or system attack designed to cause disruption to a computer, System, network or other infrastructure, or gain unauthorised access to information and systems, including: distributed denial of service, malware, viruses, Trojans, horses, spyware, worms, spam, phishing email, backdoors, botspyware, adware, diallers, toolkits, keyloggers, clickjackers, web bug, exploits, cracking tools and hacking tools or any other form of computer programming or disabling mechanism.

 


 

5. Intellectual Property

 

All intellectual property in and to the Leaving Violence Program Online Services (including content, text, graphics, logos, icons, images, video and audio clips and any other form of information content and design elements) is owned by Telstra Health or its licensors including Department of Social Services. Use of the content for any purpose other than the Permitted Purpose is prohibited.

 


 

6. Continuity of Access

 

You are responsible for your Access to the Leaving Violence Program Online Services and use of the Leaving Violence Program Online Services in accordance with these Terms. 

Telstra Health does not warrant that your Access to the Leaving Violence Program Online Services will be continuous or fault free. 

You must promptly report any loss of, or fault in, Access to the Leaving Violence Program Online Services to Telstra Health and assist the Telstra Health to investigate and restore your Access. 

Telstra Health may, acting reasonably, temporarily suspend or cancel your access to any part of the Leaving Violence Program Online Services where required to ensure the integrity of any Leaving Violence Program System.

 


 

7. General

 

You agree to comply with all laws applicable to you in relation to these Terms and your Access to the Leaving Violence Program Online Services. 

You must comply with any policies applicable to your usage of the Leaving Violence Program Online Services as notified to you by Telstra Health in writing, referred to or made available by the Telstra Health (including by reference to an internet site), including any listed in these Terms. 

Telstra Health may at any time, by written notice to you, amend these Terms. Your continued access to the Leaving Violence Program Online Services is conditional on your acceptance of those amended terms. 

These Terms are governed by the law in force in Australian Capital Territory, Australia.

 


 

8. Interpretation and Definitions

 

Unless the contrary intention appears, the following words have these meanings in these Terms:  
 

  • Access means to communicate with, instruct, operate, use, or in any way interact with the Leaving Violence Program Online Services;   
  • Access Documents means any document relating to your Access to the Leaving Violence Program Online Services set out in the Application or notified to you Telstra Health;
  • Application means the application for Access to the Leaving Violence Program Online Services as completed by you, and if applicable, includes an application to add, change or remove an Authorised User;
  • Approved Organisation means an entity who has been approved by Telstra Health as an entity that is authorised, in accordance with these Terms, to:
    • nominate Authorised Users; and
    • through its nominated Authorised Users, Access the Leaving Violence Program Online Services for the Permitted Purpose;
  • Authorised User means a natural person who has been approved to Access the Leaving Violence Program Online Services. A person may be approved by being nominated for or granted Access by an Approved Organisation;
  • Information Commissioner means the person appointed to the position of that name and responsible for the administration of the Privacy Act or his or her delegate;
  • Leaving Violence Program Online Services means any Leaving Violence Program System or service that you are provided access to by Telstra Health, including any documentation made available to you by Telstra Health via or in connection with that System or service;
  • Leaving Violence Program System means a System that is:
    • owned, operated or used by, or under the control of, Telstra Health; or
    • owned, operated or used by or under the control of a third party to provide services or information to Telstra Health (such as a bureau service),
    • and includes, to avoid doubt, the Leaving Violence Program Online Services;
  • Permitted Purpose means a lawful purpose for which you or your Approved Organisation has been permitted to Access the Leaving Violence Program Online Services by Telstra Health;
  • Personal Information has the meaning given at section 6 of the Privacy Act;
  • Privacy Act means the Privacy Act 1988 (Cth);
  • System means any system, whether networked or not, which has the ability to use, generate, process, store, communicate or transfer information (in any form) by means of computer (or other digital or analogue processing equipment) or telecommunications hardware or software;
  • Telstra Health is a reference to Telstra Health Pty Ltd, being the contracted service provider to the Commonwealth of Australia which, acting through and represented by the Department of Social Services, operates the Leaving Violence Program; these Terms is a reference to these Terms of Use;
  • You or your is a reference to the individual or other entity that accesses the Leaving Violence Program Online Services or otherwise agrees to these Terms.
